INTRODUCTION

The Gibraltar Football Association (GFA) is committed to maintaining high standards in football governance. The Club Licensing System is designed to ensure that clubs meet essential requirements across sporting, administrative, financial, and legal aspects to participate in domestic and UEFA competitions.

WHAT IS CLUB LICENSING?

Club Licensing is a mandatory process that evaluates clubs based on predefined criteria to ensure they are well-structured, financially sustainable, and professionally managed. It aligns with UEFA Club Licensing and Financial Sustainability Regulations while adapting to Gibraltar’s football landscape.

WHY IS CLUB LICENSING IMPORTANT?

Enhances the professional management of clubs.
Promotes youth development and coaching education.
Ensures financial transparency and long-term sustainability.
Protects the integrity of domestic and international competitions.
Provides clubs with a framework for continuous improvement.
Failure to comply with certain club licensing regulations and requirements will mean that a club is not eligible to recieve UEFA solidarity payments.

OBJECTIVES OF THE CLUB LICENSING & MONITORING POLICY

The GFA’s Club Licensing and Monitoring Policy aims to:

Ensure the licensing system is effectively managed and continuously improved.
Promote and enhance football standards across Gibraltar.
Establish a strong administrative and technical framework within clubs.
Implement sustainable and realistic financial measures within clubs.
Ensure efficient communication and timely processing within the licensing framework.

These objectives align with UEFA Licensing Standards while considering the specific context of Gibraltar’s football environment.

DOMESTIC vs. UEFA LICENSE

There are two types of licenses issued by the GFA:

Domestic License: Clubs with a Domestic License are eligible to participate in local competitions organised by the Gibraltar Football Association but are not permitted to compete in UEFA club competitions.
UEFA License: Clubs that obtain a UEFA License meet the additional criteria required to participate in European competitions such as the UEFA Champions League, UEFA Europa League, and UEFA Europa Conference League.

Obtaining a UEFA License requires compliance with more stringent financial, legal, and infrastructure standards in accordance with UEFA regulations.

LICENCING CRITERIA

To obtain a license, clubs must meet key requirements set out under five criterion:

CLUB LICENCING PROCESS

Application Submission – Clubs submit required documentation.
Review & Assessment – The Licensing Administration evaluates applications.
First Instance Board (FIB) Decision – Determines whether a license is granted.
Appeals Process – If a club’s application is rejected, it may appeal to the Appeals Board.
Ongoing Monitoring – Clubs must comply with continuous monitoring requirements throughout the season.

DECISION MAKING BODIES

First Instance Board (FIB): Assesses applications and issues initial licensing decisions. It has the authority to grant or refuse a license, sanction a licensee and to withdraw a license if a club no longer meets the required standards or breaches its obligations.
Appeals Board (AB): Reviews appeals submitted by clubs whose applications have been refused or whose licenses have been withdrawn by the FIB. The AB's decisions are final and binding.

Powers and Procedures:

Both the FIB and AB operate independently and are composed of qualified individuals including legal and financial experts.
Members must declare any conflicts of interest and uphold strict confidentiality.
License applicants and Licensees have the right to be heard and can be represented during the decision-making process.
Decisions are made based on submitted documentation, expert assessments, and hearings.
All decisions must be communicated in writing, with reasons for approval or refusal clearly stated, along with any applicable deadlines for appeal.

These procedures ensure a transparent, fair, and accountable licensing process for all clubs.

CONFIDENTIALITY & INDEPENDENCE

The licensing process upholds strict confidentiality and independence protocols. All decision-making members and licensing officers must declare any conflicts of interest and abide by confidentiality agreements.

MONITORING & COMPLIANCE

Licensed clubs must:

Submit quarterly financial reports.
Comply with club operational standards.
Maintain adherence to UEFA and GFA club monitoring policies.

UEFA Club Monitoring:

All Licensees that sportingly qualify for a UEFA club competition must comply with the UEFA Club Monitoring requirements which are defined in Part III of the UEFA Club Licensing and Financial Fair Play Regulations.

The club monitoring requirements, for which information will be required for affiliated clubs during each season, are the following ones:

➢ Club Information requirements which comprise information on the club’s legal group structure, its ultimate controlling party, its ultimate beneficiary and any party with significant influence over the club. Any changes to their club information occurring during the season must be promptly communicated to UEFA.

➢ Solvency requirements (overdue payables rule) to be assessed as at 15 July, 15 October and, if applicable, 15 January.

➢ Stability requirements (football earnings rule) which require the submission of financial data for the previous two reporting periods.

As in previous seasons, the monitoring information shall be submitted to UEFA via the CL/FS IT Solution unless otherwise specified or requested during the monitoring process.
