Decision of the Disciplinary Committee:

We have been asked to consider a potential breach by Lincoln Red Imps of Disciplinary Regulation 35.1 in that it is alleged that on the 24 September 2023 they fielded Ibrahim Ayew in the fixture v Lynx FC when he was ineligible.

For clarity, the history and facts are set out in the documentation provided to the board by the Gibraltar Football Association and we do not intend to repeat what is contained therein.

The submission on behalf of Lynx FC is that the player was suspended and ineligible for the match against Lincoln Red Imps as (as we understand it) the ban had to be served in the League although this was not expressly stated by Lynx fc. Inherent in this proposition although not expressly stated by Lynx is that the 23/24 rules apply and not the 22/23 rules.

For Lincoln the submission is that the 22/23 rules applied and the player was only ineligible for the Pepe Reyes cup and that in the alternative were he to be considered as ineligible for the match against Lynx a sanction must be proportionate given they had a legitimate expectation that they were entitled to field the player.

In short the board find that Lynx FC complaint is not made out. The board is of the view that the 22/23 rules applied and therefore the player was not eligible for the Pepe Reyes memorial trophy. De facto, this match was the one in which Lincoln Red Imps benefitted from an ineligible player.

Everything subsequent to that is irrelevant for the purposes of this hearing. The player was therefore in our view eligible for the Lincoln Red Imps fixture. Unfortunate as the events that unfolded were by establishing that the player was ineligible for the Pepe Reyes cup the rest of the claim made fails. For the avoidance of doubt, although an offence was technically committed we impose no penalty for the fielding of an ineligible player during the Pepe Reyes match and no further punishment is warranted.

Appeal by Lynx FC: 

Ruling by the Chairperson of the Appeals Committee Mr Patrick Canessa:

In light of regulation 52.3 I find that under regulation 8.14(c) the appeal filed by Lynx FC to be "clearly inadmissible" and therefore it will not be heard by the Appeals Committee.
